University Liability Limitations

University and University Supervisor Liability Limitations: As outlined in the Counseling Practicum or Internship Supervision Contracts, all parties to said contracts agree that they have read the Counseling Practicum or Internship Supervision Contracts in their entirety and agree to fully abide by their contents. In addition, all parties to the Counseling Practicum or Internship Supervision Contracts agree to behave legally, ethically, and professionally as defined and outlined in said documents. Furthermore, all parties to the Counseling Practicum or Internship Supervision Contracts understand and acknowledge that Southeastern Oklahoma State University, the School of Education and Behavioral Sciences, the Department of Behavioral Sciences, or any individual faculty or staff members in the Department of Behavioral Sciences will not provide any legal defense or pay for any legal expenses, including attorney’s fees, damages, or other costs incurred in the event that a counseling practicum or internship candidate, practicum or internship site, and/or practicum or internship site supervisor is sued for any legally recognized tort or act of misconduct or is investigated, charged, sued, or found liable for professional misfeasance, malfeasance, non-feasance, or other malpractice during the time period covered by the Practicum or Counseling Internship Supervision Contracts. Furthermore, the counseling practicum or internship candidate, practicum or internship site, and/or practicum or internship site supervisor will hold Southeastern Oklahoma State University, the School of Education and Behavioral Sciences, the Department of Behavioral Sciences, or any individual faculty or staff members in the Department of Behavioral Sciences harmless should they be joined in any lawsuit as a result of misconduct during the time period covered by the Counseling Practicum or Internship Supervision Contracts.

The counseling practicum or internship candidate agrees to provide proof of professional liability (malpractice) insurance and to immediately notify his or her university supervisor of any changes in said insurance coverage or if any civil or criminal charges are issued against the counseling practicum or internship candidate, the practicum or internship site, or the practicum or internship site supervisor. Lastly, all parties to the Counseling Practicum or Internship Supervision Contracts acknowledge that failure to meet any requirements set forth in the contract, withholding information referenced in the contract, providing incorrect information in filling out the contract, or providing incorrect information on any paperwork submitted in conjunction with the counseling practicum or internship course, may result in the counseling practicum or internship candidate receiving a failing grade in the course, being suspended from the Clinical Mental Health Counseling Master’s Degree Program, being dismissed from Southeastern Oklahoma State University, or other possible sanctions. Such violations may also result in the immediate termination of the Counseling Practicum or Internship Supervision Contract and/or the prohibition of future counseling practicum or internship candidates from being allowed to complete internship experiences at the above identified practicum or internship site.
